Terms and Conditions of Purchase and Use – LCD-Phone.com (B2B)

Article 1 – Scope

The website lcd-phone.com is exclusively for professional use. By placing an order, the client confirms acting for professional purposes and not as a consumer.

These General Terms and Conditions of Sale (T&Cs) govern all sales between LCD-Phone.com (“LCD-Phone”) and professional buyers (“Client”). They prevail over any purchase conditions from the Client unless agreed otherwise in writing.

Reminder: consumer legal warranties do not apply to professional clients. Only commercial warranties defined herein apply.

Article 2 – Orders

  • Formation: An order is binding upon full payment, unless otherwise agreed in writing.
  • Availability: Offers are valid while stocks last. LCD-Phone will notify the Client in case of unavailability.
  • Modification / Cancellation: Any changes require LCD-Phone’s written approval.
  • Documentation: Product visuals and specifications are indicative. The Client is responsible for ensuring compatibility.

Article 3 – Prices

  • Prices are in euros, excluding taxes. VAT and shipping are added.
  • Prices may change without notice; the applicable price is that of the order date.
  • Import duties and taxes outside mainland France are borne by the Client.

Article 4 – Payment

  • Due Date: Payment is due upon ordering (card or bank transfer), unless agreed otherwise.
  • Late Payment: Late payment results in penalty interest (+10 points above the legal rate) and a €40 recovery fee (Art. L441-10 French Commercial Code).
  • Security: LCD-Phone may require business documents (K-bis, ID) for fraud prevention.

Article 5 – Delivery and Receipt

  • Shipment via Chronopost, UPS, or equivalent. Delivery times are indicative.
  • Upon receipt, the Client must check goods and note any issues on the delivery slip, confirmed by registered mail if needed.
  • Risk transfer as detailed in Article 6.

Article 6 – Risk Transfer & Ownership

Risks (loss, theft, damage) transfer to the Client upon delivery to the carrier or upon receipt, depending on agreed Incoterms.

LCD-Phone retains ownership until full payment. In case of default, products may be reclaimed at the Client’s expense.

Article 7 – Commercial Warranties (Consumer Warranties Excluded)

Only commercial warranties provided by LCD-Phone or the manufacturer apply. Legal warranties from the Consumer Code are not applicable to B2B clients.

7.1 – General Warranty Conditions

  • Report defects within 14 days of delivery.
  • Products must be complete, clean, and returned in original packaging with seals intact.
  • Warranty excludes damage due to incorrect assembly, misuse, impact, liquid, or unauthorized software changes.
  • Shipping costs (both ways) are borne by the Client unless stated otherwise.

7.2 – Technical Products & Spare Parts

  • LCDs, glass panels, flex cables, batteries, consumables: no return or exchange if protective films or warranty labels are removed.
  • iPhone LCDs are functionally tested before dispatch. Damage from poor installation is not covered.
  • “Service Pack” items and certain original accessories may be excluded unless specified.

Article 8 – Returns & RMA

  • A valid RMA number is required before returning any item.
  • Returns must be sent with tracking and proper packaging; risks are borne by the Client.
  • Unauthorized, incomplete, or damaged returns may be refused.
  • Items unclaimed after 3 months following refusal or quotation may be destroyed.

Article 9 – Withdrawal (Not Applicable in B2B)

The right of withdrawal from the Consumer Code does not apply to business transactions. Returns outside warranty require prior written commercial agreement.

Article 10 – Liability

  • LCD-Phone is not liable for indirect damages (e.g. lost profits, data, downtime).
  • LCD-Phone is not responsible for product suitability for specific uses.
  • Force majeure: no liability for events beyond reasonable control (strikes, disasters, supplier failures, etc.).

Article 11 – Personal Data (GDPR)

Client data is processed solely for order management and commercial relations. Data is never sold to unauthorized third parties.

Requests for access, rectification, or deletion must be made via the site chat. The privacy policy is available upon request.

Article 12 – Applicable Law & Jurisdiction

These Terms are governed by French law. Any dispute falls under the exclusive jurisdiction of the Commercial Court of Paris.

Article 15 – Support & Communications

The only communication channel with LCD-Phone is the integrated website chat. All inquiries (product info, orders, RMA/returns, after-sales, billing) must be submitted there.

  • No phone or email support.
  • Opening hours: Monday–Saturday, 10 a.m.–6 p.m. (Paris time). Messages received outside hours are handled the next day.
  • Keep your chat history for easier follow-up.
